Planning Appeals

Planning Appeals

Expertly navigating the appeal process, ensuring all avenues are explored before appealing.

What are planning appeals

There are two types of Lawful Development Certificate (LDC) which a local planning authority can grant:
Where the development refers to an existing use of land, operation or work is being carried out in breach of planning conditions being lawful for planning purposes, or; Where the development refers to a proposed use of land or a building – or where work is proposed to take place in, on, under, or over the land to confirm whether it would be lawful for planning purposes.

Should I appeal?

Planning appeals are useful to specifically determine which aspects are acceptable even if the whole appeal isn’t successful. For example, if an application is refused for several different reasons, the Planning Inspectorate will consider each reason and comment accordingly. This can be very useful in determining whether the principle is acceptable before further expense is incurred on additional consultants or reports.
